I just have a question about file use. If I was to put a flash animation on my site, would it be possible to just have a note saying something such as, "If you are the original author of this file and would like it removed contact ::email::" If there is nothing within the flash file stating that it cannot be freely used and displayed?

If the author that made the flash didn't say that it can be freely distributed, do the author a favor and don't put it up.

Unless they say that it can be freely distributed, don't do it.  The author has exclusive rights to their own work.

Indeed, Untill you have express writen consent, or some sort of legit consent, you "CAN NOT" display that content, in any way, shape or form.

Some work comes with a GPL, some dosen't, untill your 100% sure, don't do it, you could get charged with something like
copyright infringment!
